A Helping Hand is defined as “a person who is employed for remuneration whether in cash or kind, in any household through any agency or directly, either on a temporary or permanent, part time or full time basis to do the household work, but does not include any member of the family of an employer”.

Our goal is to create a sustainable living environment by working towards:

• Making neighbourhoods safe & crime free 
• Making it easy for the residents to recruit HH and in return also making it easier for the helping hands to get a job
• Creating a performance-based culture within HHs
• Utilizing the services of the residents for upliftment of the HHs

Our mission is to use technology to help neighbours meet the above-mentioned goals of building stronger and safer neighbourhoods. You agree to either contribute positively or not disrupt the mission undertaken by LH regarding the HH Program. If you do not accept the Terms regarding HH, then you are not allowed to create your account or to use LinkingHuts, and you must promptly cancel or deactivate your account.

• You’ll be responsible (not accountable) for verification and periodic updation of the Profile information of each of the HHs currently working for you and thereby attached to you in the system. But it’s not mandatory for you to do so and you may decide to rely on the verification & reliability checks done by the other neighbour members for the specified HH (which may or may not be correct)
• You’ll be responsible (not accountable) for the first-time verification of the HHs registered by you on the LH platform, whether or not they currently work with you. You may also ask for their verification details at any point of time even if they are already registered and deemed to be verified
• You must not provide us or publish on the platform any HH related data that :
  • Is not part of the HH Registration Form
  • Is confidential & sensitive information related to HH’s health & wealth
  • You don’t have the approval or the right to publish anything that violates any code of conduct or ethics applicable to you, or that is defamatory, infringing, illegal or otherwise tortious.
• While registering a new HH, you’ll be responsible (not accountable) for explaining the HH the below mentioned points for the HH to take an informed call as to whether to join the platform or not:
  • About the Platform:
    • What the platform is all about
    • What’s the role of the HH section – How would it help both Residents & HHs
    • Profile Visibility
    • Who all the profile would be visible to (i.e. residents in the neighbourhood) Please explain that the HHs profile would be publicly viewable within your neighbourhood
    • What all in the Profile would be visible
    • Profile Editing
    • How & through whom the profile can be edited & can it be edited anytime
    • Profile Removal
    • How & through whom the profile can be removed
    • Communication with the Residents
    • Helping Hands can’t view, search, or otherwise access conversations or direct-messages between neighbour members. They can’t even write messages to neighbour members
    • About Ratings & Reviews by Employers
    • Who all can provide the ratings
    • Can somebody intentionally provide a bad rating and what can be done to avoid injustice – Verbally explain that no resident would provide a bad rating for no reason and also that a bad rating would affect a person’s overall rating only if all the HH’s employers provide a bad rating which would bring down his / her overall rating.

• Under no circumstances will you hold LH or any neighbour member responsible for inaccurate data, wrong or incorrect verification, and non-updation of the HH’s profile, ratings, reviews etc. Similarly, LH or any other neighbour member will also not hold you solely responsible for any incorrect information or non updation of data. The updation & verification of HH information is the joint responsibility of HHs and the residents.
• LinkingHuts has no obligation to verify the accuracy of HHs Profile Information, fed by residents on the LH Platform on the basis of the information provided by the Helping Hands. 
• LH provides no guarantee of performance, work environment etc to either the residents or the HHs for getting into any sort of work-related understanding or pact. It is just an enabling platform to help residents & HHs take informed decisions. Eventually, the final decision to hire & employ an HH OR to get hired & employed by a resident would solely be between Residents & HHs and LH would not be held responsible for any such decision, good or bad, right or wrong. 

• LH does not employ & supervise the HHs and therefore can’t vouch for the ratings & reviews of the HHs and any ratings / reviews provided by any resident pertaining towards the HHs would solely be his / her own decision.
• Though LH does not control the ratings & reviews but if it is reported to LH that any review is not based on performance related factors like Quality of Work / Discipline / Work Behaviour / Ethics / Integrity / Crime & Safety etc but is based on other factors like Race / Region / Religion / Caste / Color etc, then LH has the right to remove that review & associated rating from the platform. LH does not allow HH reviews that :
  • Are not in appropriate Language
  • Are discriminatory
  • Are offensive to good taste
  • Are Politically or Religiously motivated
  • Assert or imply personal attributes such as financial status, alleged/actual commission of a crime, political affiliation/beliefs, racial or ethnic origin, religious or philosophical affiliation/beliefs, sexual behaviour or orientation, trade union membership, age, gender identity, disability, medical condition (including physical or mental health)
• You’ll not disclose or discuss the Personal information (Profile / Ratings / Review etc) of the HHs (working in your neighbourhood) with anybody else except the neighbourhood members, without our explicit or written permission
• You’ll provide ratings & review for an HH in an extremely unbiased & unprejudiced manner
• Similarly, you will not provide exaggerated ratings & reviews as that can mislead the fellow neighbour members 

As per the LH’s mission of creating sustainable living environment by reducing disparity and inequality in society, you agree that:

• You will treat the HHs with respect & dignity and will not ill treat them
• You will not financially exploit the HHs by taking advantage of their poor & vulnerable conditions
• You will not physically abuse the HHs in form of violence, sexual harassment etc
• As per law, you will not employ children below the age of 14 as domestic Servants
• You will not discriminate any HH on the basis of Caste, Language, Race, Colour, Community, Region & Religion
• You will adhere to all laws pertaining to HHs

• You acknowledge that LH may provide you with certain information regarding HHs that is proprietary and confidential to LH, such as HHs Profile, Rating, Reviews & aggregated statistics about neighbourhood HHs. You agree to keep the LH Information confidential, not to disclose it to any third party, and to use it only as permitted by LH for your neighbourhood purposes. If you believe that you must disclose LH Information in connection with a subpoena or similar legal duty, you will notify LH in writing before doing so, and you agree to provide LH with reasonable assistance if LH seeks an order maintaining the confidentiality of the LH Information.
• You will indemnify LH for any losses of life & material created by any HH who was hired by you based on the information, ratings & reviews provided on the LH Platform by your fellow neighbours

In case it is found that a Resident or an HH has breached the HH terms of agreement, LH can take suitable action against them which can lead to Warnings or Temporary / Permanent removal of the Resident’s account or HHs Profile (as applicable) from the Platform

The validity, construction and performance of this Agreement shall be governed and construed in accordance with the laws of India.  The district and state courts located in Gurgaon, Haryana shall have sole and exclusive jurisdiction over any disputes arising under, or in any way connected with or related to, the terms of this Agreement.

This Agreement shall remain in effect for as long as your membership on LH Platform.  At the end of the membership period, this agreement shall cease to exist and all confidential information regarding HHs needs to be destroyed. It can neither be shared with anybody else nor be used for any commercial purposes.

• All obligations contained in this Agreement shall extend to and be binding upon the parties to this Agreement and their respective successors, assigns and designees.
• Although the restrictions contained in this Agreement are considered by the parties to be reasonable for the purpose of protecting the Confidential Information, if any such restriction is found by a court of competent jurisdiction to be unenforceable, such provision will be modified, rewritten or interpreted to include as much of its nature and scope as will render it enforceable.  If it cannot be so modified, rewritten or interpreted to be enforceable in any respect, it will not be given effect, and the remainder of the Agreement will be enforced as if such provision was not included. 

You understand that, while we do our best to provide our services, we cannot promise that these services, including our website, applications, and software, will always function and function correctly. 

These Terms (including this addendum, the member agreement, and the privacy policy) constitute the entire agreement. We may, at any time, and at our sole discretion, modify these Terms and Conditions of Use, including our Privacy Policy, with or without notice to you. Any such modification will be effective immediately upon public posting. Your continued use of our Service and this Site following any such modification constitutes your acceptance of these modified Terms. You can de- register if you disagree with the new terms.
