LinkingHuts Member Agreement
Welcome to LINKINGHUTS (Hereafter referred to as either “LINKINGHUTS” or “LH”)! This agreement lists out your rights and responsibilities in your use of LINKINGHUTS’ website, mobile apps, and services, both as a visitor and as a registered LINKINGHUTS member, and also what can be expected out of us. By clicking “I accept” or by indicating any other way that you agree, you are agreeing to the terms mentioned herewith. Therefore, it’s imperative that you read this legally binding agreement carefully.
LINKINGHUTS is a private social network for connecting neighbourhoods wherein neighbours all across can use the platform to build stronger, safer, mutually beneficial & truly enriching neighbourhoods around the world. We use “LINKINGHUTS or LH” here to refer to the LINKINGHUTS.com website and our iOS and Android apps (also referred to as our “Services”) that provide you with access to the platform. We also use “LINKINGHUTS or LH” to refer to the companies operating our Services.
In case any part of this agreement applies only to a specific member(s) i.e. a Resident or a Business or a Neighbourhood Admin, it might either be specifically called out or if not specifically called out, then only the relevant members, to whom that part is applicable, need to consider the same & others may just ignore it.
Here are some commitments you make to us relating to registering and maintaining the security of your account:
- To only have one personal account for yourself.
- Not to share your account password with anyone else (even with a family member sharing your home) & not to allow someone else to use your personal account or do anything else that might endanger or compromise the security of your account.
- To use your real name, not a pseudonym.
- Not to provide any false personal information on LINKINGHUTS.
- Not to create an account for anyone else other than yourself without our permission
- To keep your contact information accurate and updated at all points of time.
- That if you are under 15 years old (or any older age - where consent is required to use social media services where you live), you will not use our services or provide any data to us.
- That in case your account is disabled by us for any reason, you will not create another account without our permission.
Convicted sex offenders are not eligible for LINKINGHUTS accounts; and we may also deny, disapprove or disable any account registrations we think would harm a LINKINGHUTS neighbourhood.
- To have only one account for the same business or same brand or same product or same service line owned by you though you’ll be allowed to have separate accounts for different business or different brand or different product or different service line
- Not to share your account password with anyone else (except the people authorised by you) & not to allow someone unauthorised to use your Business account or do anything else that might endanger or compromise the security of your account.
- To only use the Business’ real name, not a pseudonym.
- Not to provide any false personal information on LINKINGHUTS, or create an account for any business other than your own, without permission from the real business owner .
- To keep your contact information fully accurate and updated at all point of times .
- That if your business requires consent to use social media services where you live, please do not use our services or provide any data to us till you obtain the requisite consent. Illegal Businesses are not eligible for LINKINGHUTS accounts; and we may also deny, disapprove or disable any business account registrations we think would harm the LINKINGHUTS platform & its members.
- That in case your account is disabled by us for any reason, you will not create another account without our permission.
- To create only one account and that too for the neighbourhood you administer.
- To create an account only if you have the rightful document or proof to suggest that you are the true Neighbourhood Admin for that particular neighbourhood.
- Not to provide any false personal information on LINKINGHUTS, or create an account for any other neighbourhood than your own.
- Not to share your account password with anyone else (except the people authorised by you) or not to allow someone unauthorised to use your Neighbourhood Admin account or do anything else that might endanger or compromise the security of your account.
- To keep your contact information fully accurate and updated at all point of times.
- That if your account requires consent to use social media services where you live, please do not use our services or provide any data to us till you obtain the requisite consent. We may deny, disapprove or disable any account registrations we think would harm the LINKINGHUTS platform & its members
- That in case your account is disabled by us for any reason, you will not create another account without our permission.
You agree that:
- It is not acceptable to submit inaccurate registration information, or to register if you know you don’t meet our eligibility requirements.
- Providing false registration information violates our norms and could constitute a crime.
- You will let us know immediately, the moment you come to know about any wrong address getting verified by us or any wrong member becoming a member of a neighbourhood.
- Though the platform would make all efforts to enforce the eligibility requirements, but no processes are completely foolproof or perfect .
- Each member should always be on alert & high vigil to ensure that his / her neighbourhood always remains absolutely free from any unwanted element.
LINKINGHUTS offers personal accounts to individual residential members and special accounts with restricted functionalities to Businesses and Neighbourhood Admins. Special accounts agree to additional terms and cannot see neighbourhood discussions, nor can they access private messages between neighbours. You agree:
- Not to use your personal / residential member page or Neighbourhood Admin page for your own commercial gains, and instead use a Business Page for such purposes.
- Not to share, transfer or handover your account to anyone else without first getting our written permission.
If you select a name or an image or a logo that acts as an identifier for your account but which we believe is inappropriate (such as when a trademark owner complains about your name that does not closely relate to your actual name or closely relates to a name owned by the complaining trademark owner), we reserve the right to remove or reclaim it.
- Send posts on your Homepage which is visible to the residents who visit your page.
- Make your posts visible to your follower residents on their homepage itself .
- Receive comments on your posts from the residents and be able to reply to them.
- Receive private messages from the residents and be able to reply to them .
You can change your preference about receiving comments on your posts by disabling comments on your post.
- Send & receive posts for your neighbourhood & connected friends.
- Send & receive comments on Posts for your neighbourhood & connected friends
- Receive posts from the Followed Businesses & be able to comment on those posts, if allowed by the respective businesses.
- Receive posts / messages from your Neighbourhood Admin & be able to reply to them .
- Receive private messages from residents and be able to reply to them.
- Muting / Unmuting your Neighbours / Friends or
- Friending / Unfriending your Friends or
- Following / Unfollowing a Business or
- Disabling Comments on your own post or
- Changing Account Settings for receiving messages (allow Anyone / No one at LH to send message to you)
You can change your preferences about receiving posts or messages from Friend / Neighbour / Business or any other member on the platform by:
- Send & receive - Messages / Replies to these messages - to & from your Neighbourhood residents. The message sent by you would be delivered to all residents of your neighbourhood only without you being able to send it selectively to the residents. On the other hand, residents will have the option to message either only to you or to you along with all neighbours. Here, even residents can’t choose to mark only select residents while messaging you. If residents have marked to all residents while messaging you, then while replying, you may choose whether to reply only to the resident who originated the message or to all residents
- Receive attachments from your neighbourhood residents. You can change your preferences about receiving posts or messages from your neighbourhood residents by :
- Disabling comments on your own post. There are no other changes you can make to your preferences about communicating with your neighbourhood residents.
Your privacy is very important to us. We designed our Policy to make important disclosures about how you can use LH to share with others and how we collect and can use your content and information. We encourage you to read the Policy, and to use it to help you make informed decisions.
We are sure that you do not want spam or marketing phone calls from third parties, so we will never sell or rent your personal information to third parties, and for any reason, we won’t even share it with a third party unless we have your authorisation. Our privacy policy explains how we handle member and visitor data collected and generated in the course of visiting or using LINKINGHUTS. Please read it, as it forms an important & integral part of this agreement.
If you are a non-India member or visitor, then by continuing to use LINKINGHUTS, you authorise us to transfer, store & process your data outside your home country, including to and in India. LINKINGHUTS will only transfer personal data as permitted by law, and will take steps intended to ensure appropriate protection of your personal information; please review our privacy policy for details. If you have questions, please contact us.
You retain all ownership rights to the text, photos, videos, and other content you submit to LINKINGHUTS (collectively, your “Content”). You give us permission, in the form of a non-exclusive transferable, sub-licensable, royalty-free worldwide license, to use, copy, share and publish your content based on your account specific LINKINGHUTS settings and the selections you make when posting and as otherwise described in our Privacy Policy. In addition:
- This IP License ends when you delete or remove your IP content or deactivate your account unless your content has been shared with others, and they have not deleted it
- When you delete or remove IP content, it is deleted or removed in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others)
- When you use an application, the application may ask for your permission to access your content and information as well as content and information that others have shared with you. We require applications to respect your privacy, and your agreement with that application will control how the application can use, store, and transfer that content and information. (To learn more about Platform, including how you can control what information other people may share with applications, read our Privacy Policy
- If you are joining as a Business Member, then when you publish content or information on your business page, it would be accessible to the public who would visit your Business Page and would also be made accessible to people who follow your business page. By publishing your content, you allow the above-mentioned people to access and use that information, and to associate it with you (i.e., your name and profile picture)
- If you are joining as a Resident Member, then when you publish content or information at your Home Page, you may choose to share it with either your neighbours or connected friends or both. Under no circumstances, your content would be shared with the people who are neither your neighbours nor your connected friends. Similarly, the content you share on a group page would only be visible to the members of that group and not beyond that. Your timeline can at most be visible to your friends and that too if your Account Settings allow the same. By publishing your content, you allow the above-mentioned eligible set of people to access and use that information, and to associate it with you (i.e., your name and profile picture)
- If you are joining as a Neighbourhood Admin,then when you send a message, it would be accessible to your neighbourhood residents only who would receive your message in their inbox. By publishing your content, you allow the above-mentioned people to access and use that information, and to associate it with you (i.e., your name and profile picture)
We would always appreciate & look forward to your feedback or other suggestions about LINKINGHUTS, but you understand that we may use your feedback or suggestions without any obligation or liability to compensate you for offering them (just as you have no obligation to offer them to us)
At LINKINGHUTS, we believe that good behaviour by Businesses, Residents & Neighbourhood Admins Community is the foundation of healthy relationship amongst them. Our Community Guidelines outline our expectations regarding appropriate use of LINKINGHUTS, including how members interact with each other. We respect other people's rights, and expect you to do the same. In using LINKINGHUTS and its member-to-member transactional features, you, like every member, are acting on your own behalf and are responsible for your own decisions and actions, including posting content and interactions with members you meet through LINKINGHUTS.
You need to ensure that all members feel welcome, safe, and respected. Though it’s our constant endeavor to keep LINKINGHUTS safe, but we cannot guarantee or promise it. We need your help to keep LINKINGHUTS safe, which includes the following commitments by you:
- You will not provide us with any content that you don’t have the right to publish, or that is defamatory, infringing, illegal, spam, unauthorised commercial communications or otherwise tortious. You will not engage in unlawful multi-level marketing, such as a pyramid scheme, on LINKINGHUTS. You will not post content or take any action on LH that infringes or violates someone else's rights or otherwise violates the law. You will not post anyone's identification documents or sensitive financial information on LH. If you believe content on LINKINGHUTS infringes your copyright, you can contact us
- You will not collect users' content or information, or otherwise access LINKINGHUTS, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our prior permission. If you collect information from users, you will obtain their consent, make it clear that you (and not LH) are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it
- We can remove any content or information you post on LH if we believe that it violates this Agreement or our policies. If we remove your content for infringing someone else's copyright, and you believe we removed it by mistake, we will provide you with an opportunity to appeal. If you repeatedly infringe other people's intellectual property rights, we will disable or deactivate your account as & when deemed appropriate by us to do so. Also, you will not use our copyrights or Trademarks or any confusingly similar marks, except with our prior written permission
- We do not proactively screen or monitor content posted by members; however, we can remove content posted by you, suspend, delete or deactivate your account or other privileges, or otherwise refuse service to you, if you violate this agreement or our other policies, or infringe intellectual property, or otherwise engage in behaviour that we think harms a LINKINGHUTS neighbourhood
- If you write a recommendation or comment about another resident or a business (for example, a recommendation of a tutor), be truthful, fair and neighbourly in your comments, and do not post any of their personal information (e.g., address, mobile number, or photos) without their permission
- You will not upload viruses or other malicious code
- You will not solicit login information or access an account belonging to someone else
- You will not promote the events or activities of hate groups or terrorist organizations
- You will not post contents (includes Posts, Messages, Polls, Groups, Events, Comments, Reviews, Images, Videos, any other Document, Remarks etc.) that :
- Insult groups - based on race, colour, ethnicity, national origin, religion, caste, gender, gender identity, sexual orientation, political or religious affiliation, age, medical / physical condition or disability
- Use derogatory racial terms or code words that insult or reduce one’s humanity
- Use inflammatory language when describing people who have committed crimes. Keep in mind that everyone is someone’s son or daughter or sister or brother
- Discriminate against, attack, intimidate, berate, insult, shame, bully, belittle, harass, threaten, troll, or swear at others or their views even if you disagree with them
- Are inaccurate, defamatory, obscene, pornographic, shocking, hateful, threatening, incites violence, tantamount to a hate speech or otherwise inappropriate
- Relate to over-posting, campaigning, and posting or ranting about controversial, non-local issues, unsolicited or unauthorised advertising, “junk,” “spam,” “pyramid schemes,” or any form of solicitation unauthorised by LH
- Relate to airing personal grievances or disputes or publicly shaming any member. LINKINGHUTS is not a place for publicly resolving personal disputes and grievances
- We rely on our members to report the details of the above content. Note that we may delete your posts that other members may find offensive. Again, we want everyone to feel welcome on LINKINGHUTS. For details, please check our Community Guidelines.
- You will not develop or operate a third-party application (in conjunction with LINKINGHUTS Platform or services) which contains alcohol-related, dating or other mature content (including advertisements) without appropriate age-based restrictions (As per country specific law)
- You will not use LH to do anything unlawful, misleading, malicious, or discriminatory
- You will not do anything that could disable, overburden, or impair the proper working or appearance of LH, such as a denial of service attack or interference with page rendering or other LH functionality.
- You will not facilitate or encourage any violations of this Agreement or our policies
Some members take on a volunteer role for their neighbourhood, to help manage their neighbourhood on LINKINGHUTS. Volunteers are not LINKINGHUTS employees, representatives, or agents. LINKINGHUTS does not interview, run background checks on, monitor, supervise, or control LINKINGHUTS members, including those who volunteer, and your use of Business Pages or any similar feature does not make us an employer, placement agency, representative, or agent of or for you or any other neighbour or service provider. If you and another member decide to work together, the two of you, and not LINKINGHUTS, are responsible for complying with any laws that might apply, such as tax or employment laws. LINKINGHUTS is not a party to transactions or disputes between members.
In the real world and online, neighbours & friends sometimes disagree. While we hope other members will be neighbourly & friendly, we don’t control and aren’t responsible for their actions; we encourage you to do your own research before deciding to do business with another member. If you have a dispute with another LINKINGHUTS member, we hope that you will be able to work it out amicably. However, if you cannot, please understand that LINKINGHUTS is not responsible for the actions, content, information or data of its members or any of the third parties; each member is responsible for their own actions, content, data and behaviour, whether using LINKINGHUTS or chatting over the back fence. Accordingly, to the maximum extent permitted by applicable law, you release us (and our officers, directors, agents, subsidiaries, joint ventures, employees and any other representative) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. If you have a dispute with LINKINGHUTS, you agree to contact us and try to resolve the dispute informally before pursuing other avenues.
In the event you change or deactivate your contact number, you will update your account information on LH within 48 hours to ensure that the OTPs, if any generated for you, are sent to the correct mobile number and also the correct number gets displayed on your profile (in case it’s allowed to be displayed as per platform policy in conjunction with your profile settings) for a member to be able to contact you.
Some of the information and services available through LINKINGHUTS are licensed from third parties and covered by these third-party terms and disclosures:
- Some data on LINKINGHUTS.com could be licensed from licensors like Google Maps etc. You may not directly or indirectly sell, distribute, reverse engineer, or sublicense any such licensed content (or any portion thereof) on LH other than as part of our services. Duplication of this data is strictly prohibited.
- Some map information, business address information, and contact information could also be licensed from third parties, including Google, Inc. via its Maps API. Google Maps and Places information, if any, is provided subject to Google’s Terms of Service, including the Google Maps/Google Earth APIs Terms of Service, and its privacy policy.
- You may not sublicense, resell, or otherwise distribute any data from our third-party licensors to any third party; it is only for your internal personal use.
- Users of our iOS application are subject to the following terms required by Apple: To the maximum extent permitted by applicable law, Apple does not have any warranty obligation with respect to the LINKINGHUTS iPhone app. Apple is not responsible for addressing any claims by you or any third party relating to the LINKINGHUTS iPhone app or your possession or use of it, including, but not limited to: (i) product liability claims; (ii) any claim that the LINKINGHUTS iPhone app does not conform to any applicable legal or regulatory requirement; (iii) claims arising under consumer protection or similar legislation; or (iv) any infringement of a third party’s intellectual property rights. Where permitted by law, Apple, its subsidiaries and our other suppliers are third-party beneficiaries of this agreement, but no one else is. Without limiting the foregoing, (1) upon your acceptance of this agreement, Apple will have the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary, and (2) Apple is not a party to this agreement and is not responsible for the LINKINGHUTS iPhone app or its contents.
If you create or administer a Business Page on LH, you agree to our Business Pages Terms. In addition, your advertising or other commercial or sponsored activity or content placed on LH or if you run a promotion or an offer from your Business Page, it will have to comply with our Advertising, Promotion & Content (APC) Policy for a Business Page.
Our goal is to deliver advertising and other commercial or sponsored content that is valuable to our users and advertisers. In order to help us do that, you permit us to display your name and/or profile picture with your content or information, on any of the advertisement or promotion material without any compensation to you.
- You will not modify, create derivative works of, decompile, or otherwise attempt to extract source code from us, unless you are expressly permitted to do so under an open source license, or we give you express written permission. If you are a developer or operator of a Platform application or website or if you use Social Plugins, you must comply with our platform policies
- If you download and install the LINKINGHUTS app, we give you a limited non-transferable license to use it only to access and use LINKINGHUTS on your own behalf through your iOS or Android product; additional terms may apply from the site you download it from (Apple App Store or Google Play Store) or the manufacturers of your device or software. You also agree that from time to time, the software may download and install upgrades, updates and additional features from us in order to improve, enhance, and further develop the software
You agree that LINKINGHUTS, its partner firms, any of its directors, employees, agents or representatives shall not be liable for any lost profits or special, incidental or consequential damages (however arising, including negligence) arising out of or in connection with LINKINGHUTS, including the LINKINGHUTS services, our software, your use of LINKINGHUTS or any LINKINGHUTS service, or this agreement and shall not be liable to you for more than $100. Some jurisdictions do not allow damages exclusions, so they may not apply to you.
If you make a payment on LINKINGHUTS, you agree to our Payment Terms unless it is stated that other terms apply.
LINKINGHUTS and the associated software and services are provided “as is.” We try to keep LINKINGHUTS up, bug-free, and safe, but you use it at your own risk. We are providing LINKINGHUTS as is without any express or implied warranties including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that LINKINGHUTS will always be safe, secure or error-free or that LINKINGHUTS will always function without disruptions, delays or imperfections. We do not promise that any aspect of our software or service will work properly or continuously. We may add, change, or discontinue product features; if you are dissatisfied, your only remedy is to stop using LINKINGHUTS or the affected feature. Some jurisdictions do not allow warranty exclusions, so they may not apply to you.
LINKINGHUTS is not responsible for the actions, content, information or data of its members or any of the third parties; each member is responsible for their own actions, content, data and behaviour. If someone brings a claim against LINKINGHUTS (whether against the company or any of its employees, directors, officers, representatives) based on a harm caused by you, you will be solely responsible for any legal consequences arising out of it and also agree to reimburse us for any costs we incur in defending against that claim, including all legal expenses as well as reasonable damages.
If you violate the letter or spirit of this Statement, or otherwise create risk or possible legal exposure for us, we have the right to deactivate your account. You may also deactivate your account and delete application from your device at any time.
This agreement is governed by Indian laws. You and LINKINGHUTS both agree that (i) any claim or dispute regarding LINKINGHUTS will be resolved exclusively by the state courts located in Gurgaon, Haryana, India and (ii) we each agree and submit to the exclusive personal jurisdiction of this court for litigating such claims or disputes.
This agreement includes our :
- Privacy Policy,Copyrights Policy,Cookies Policy,Business Pages Terms,APC (Advertising, Promotion & Content) Policy and Payment Terms – Applicable to all Members.
- Helping Hands’ Terms – Applicable to Resident Members & Neighbourhood Admins.
- This agreement does not create any agency, partnership, joint venture, employment or franchise relationship
- Any unenforceable portion of this agreement shall be enforced to the maximum extent possible, and the remaining portions will remain in full force and effect
- Our failure to act in a particular circumstance does not waive our right to act with respect to that or other circumstances. We shall be excused for any problem due to circumstances beyond our reasonable control
- Any amendment to or waiver of this agreement must be made in writing and signed by us. You will not transfer any of your rights or obligations under this agreement to anyone else without our consent
- All of our rights and obligations under this agreement are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise
- Nothing in this agreement shall prevent us from complying with the law
- This agreement does not confer any third-party beneficiary rights
- We reserve all rights not expressly granted to you
- You will comply with all applicable laws when using or accessing LH
- You represent and warrant that you are not (i) located in a country that is subject to the Indian Government embargo or has been designated by the Indian Government as a “terrorist supporting” country; and (ii) listed on any Indian Government list of prohibited or restricted parties. If you are located in a country embargoed by the Indian Government you will not engage in any activity on LINKINGHUTS
Just to reiterate, in case any part of the above agreements or guidelines applies only to a specific member(s) i.e. a Resident or a Business or a Neighbourhood Admin, it might either be specifically called out there itself or if not specifically called out, then only the relevant members, to whom that part is applicable, need to consider the same & others may just ignore it. It constitutes the entire agreement between you and us with respect to our Services, and supersedes any other agreements or understandings (oral or written). You agree that:
You agree to have reviewed the following documents, which provide additional information about your use of LH:
- Payment Terms: These additional terms apply to all payments made on or through LINKINGHUTS, unless it is stated that other terms apply
- Privacy, Cookies & Copyrights Policy: This page helps you better understand what happens when you add a third-party application or use LINKINGHUTS, including how they may access and use your data
- Advertising, Promotion & Content Policy Guidelines for a Business Page: These guidelines outline the policies that apply to Advertisements, Promotions & Business Content placed on LINKINGHUTS
- Business Pages Terms: These guidelines apply to your use of LINKINGHUTS Business Pages
- Community Guidelines: These guidelines outline our expectations regarding the content you post to LINKINGHUTS and your activity on LINKINGHUTS
Because LINKINGHUTS provides a wide range of Services, we may ask you to review and accept supplemental terms that apply to your interaction with a specific app, product, or service. To the extent those supplemental terms conflict with this agreement, the supplemental terms associated with the app, product, or service govern with respect to your use of such app, product or service to the extent of the conflict.
We can either amend this agreement or any of the above-mentioned policies which are also an integral part of this agreement or integrate additional terms or new policies to this agreement by notifying you of the changes (for example, by emailing you, or by posting a message regarding the amendment notice). If you keep using LINKINGHUTS after the amendment is effective, you accept and are bound by the new terms, policies or guidelines; if you disagree with the new terms, policies or guidelines, you should stop using LINKINGHUTS and deactivate your account.
- By "LINKINGHUTS" or ”LH” we mean the features and services we make available, including through (a) our website at www.LinkingHuts.com and any other LINKINGHUTS branded or co-branded websites (including sub-domains, international versions, widgets, and mobile versions); (b) our Platform; (c) social plugins; and (d) other media, brands, products, services, software, devices, or networks now existing or later developed. LINKINGHUTS reserves the right to designate, in its sole discretion, that certain of our brands, products, or services are governed by separate terms and not this one
- By "Platform" we mean a set of APIs and services (such as content) that enable others, including application developers and website operators, to retrieve data from LINKINGHUTS or provide data to us
- By "information" we mean facts and other information about you, including actions taken by users and non-users who interact with LH
- By "content" we mean anything you or other users post, provide or share using LINKINGHUTS Services
- By "data" or "user data" or "user's data" we mean any data, including a user's content or information that you or third parties can retrieve from LINKINGHUTS or provide to LINKINGHUTS through Platform
- By "application" we mean any application or website that uses or accesses Platform, as well as anything else that receives or has received data from us. If you no longer access Platform but have not deleted all data from us, the term application will apply until you delete the data.
